Terms of Service
1. Who we are
Mangaale Partner is a business application for restaurant owners and their staff. These terms are issued by MANGAALE QUICK COMMERCE (OPC) PRIVATE LIMITED (CIN U47912UP2026OPC251523), registered office: Village Kadrabad, P.O. Kadrabad, Kadrabad, Nagina, Bijnor – 246722, Uttar Pradesh, India ("Mangaale", "we", "us").
By creating an account or using the app you ("you", "the Operator") agree to these terms. If you do not agree, do not use the app.
2. Who may use the app
The app is for businesses, not consumers. You may use it only if:
- you are at least 18 years old;
- you are authorised to act for the restaurant you register; and
- the details you give us at registration are accurate and kept up to date.
The app is not directed to children and must not be used by them.
3. Your account
You are responsible for your account credentials and for everything done under your account, including by staff and riders you add. Tell us immediately if you believe an account has been compromised.
You may create accounts for staff and riders. You are responsible for those people's use of the app and for the personal data you enter about them, and you confirm you have the right to provide it.
4. Restaurant verification
A newly registered restaurant is reviewed before it is activated. We may approve, delay, or decline a registration, and we may ask for documents such as FSSAI licence, GST registration or PAN to verify your business. Until a restaurant is approved the app shows a review screen and order features are not available.
5. What the app does
Subject to these terms we grant you a limited, non-exclusive, non-transferable, revocable licence to use the app to run your restaurant, including: managing menus and inventory, receiving and fulfilling orders, printing receipts, viewing sales reports, and managing staff, riders and outlets.
We may add, change or remove features. We will not remove a material feature without reasonable notice unless we must do so for legal or security reasons.
6. Fees and settlement
6.1 Plans and prices
We may offer free plans, monthly subscriptions, annual subscriptions, per-order or platform-fee plans, premium features, restaurant or merchant subscription plans, hardware and printer-related services, promotional plans, and custom commercial arrangements.
The price that applies to you will be communicated to you before the charge becomes payable, through one or more of: the Mangaale application, the partner dashboard, the subscription screen, an invoice, an order form, an onboarding agreement, a commercial agreement, or other official Mangaale communication.
6.2 Billing cycle
Depending on your plan, billing may be monthly, annual, per order, usage-based, or as separately agreed in a commercial arrangement.
6.3 Taxes
All prices and fees are exclusive of GST and other applicable taxes unless expressly stated otherwise. We may charge and collect applicable taxes where legally required.
6.4 Payment due date
Payments must be completed by the due date shown on the relevant invoice, dashboard, subscription screen, order form or commercial agreement.
6.5 Overdue payments
Where an undisputed amount remains unpaid beyond its due date, we may send payment reminders, restrict paid features, suspend paid services, or prevent subscription renewal until the outstanding amount is cleared.
We do not impose late-payment interest unless the applicable commercial arrangement expressly provides for it.
6.6 Price changes
We may modify subscription prices, per-order charges, platform fees, premium feature prices and other commercial charges. We will give at least 30 days' prior notice before a material price increase takes effect for an existing Partner. A subscription period you have already paid for will not be retrospectively repriced.
6.7 How settlement works today
For clarity, and reflecting how the app currently works:
- Fees are not collected inside the app. The app displays your account balance and your invoices, but it does not process payments. Your account manager raises invoices and settles them with you outside the app.
- Amounts shown in the app are records of your account. They are not offers to sell and do not create a purchase inside the app.
- You remain responsible for your own taxes, and for the tax treatment of the sales you record through the app.
Money your customers pay you for food is yours and does not pass through the app. The app records payment method and status so you can reconcile your own takings; it does not hold or transmit those funds.
7. Your content and your data
You keep ownership of everything you put into the app — your menu, prices, item photos, customer records, order history and business details ("Your Content").
You grant us the licence needed to host, process, back up and display Your Content so we can operate the app for you, and to produce anonymised, aggregated statistics that cannot identify you or your customers.
You are responsible for Your Content being lawful and accurate. In particular you must have the right to upload any image you add, and food descriptions and prices you publish must not be misleading.
8. Customer personal data
Where you enter customer details (name, phone number, address, order history) you are the controller of that data and we process it on your behalf. You must:
- collect it lawfully and tell your customers what you do with it;
- use the marketing features only to message customers who have agreed to be messaged, and honour opt-outs; and
- not upload sensitive personal data you do not need.
Our handling of personal data is described in the Privacy Policy, which forms part of these terms.
9. Availability and support
We aim to keep the app available but do not guarantee uninterrupted service. Maintenance, third-party outages and connectivity problems can interrupt it.
Some features depend on your own hardware and connections — thermal printers, Bluetooth, the device camera and microphone, and a working internet connection. We are not responsible for failures caused by them.
9.1 How to reach support
| Support email | supportmangaale@gmail.com |
| Official company email | officialmangaale@gmail.com |
| Standard support hours | Monday to Saturday, 10:00 AM – 7:00 PM IST, excluding applicable public holidays |
Issues involving order processing, platform availability, account access, restaurant operations or security incidents may be prioritised depending on severity and operational availability.
9.2 Service levels
We will make commercially reasonable efforts to acknowledge and address support requests based on their nature, severity and available resources. Unless expressly agreed under a separate written Service Level Agreement, we do not guarantee any specific response time, resolution time, uptime percentage or service availability level.
10. Acceptable use
You must not:
- use the app for anything unlawful, or to sell anything you may not lawfully sell;
- reverse engineer, decompile or attempt to extract source code, except as applicable law allows;
- probe, scan or attempt to breach the app or our systems, or use automated means to place load on our APIs beyond normal use of the app;
- resell, sublicense or provide the app as a service to another business; or
- upload malware, or content that infringes someone else's rights.
11. Suspension and termination
You may stop using the app at any time and may request deletion of your account from Profile → Delete account, or by following https://mangaale.com/account-deletion.
11.1 Termination for convenience
Either party may terminate the commercial relationship for convenience by giving at least 30 days' written notice. Any undisputed outstanding payment obligations must still be cleared.
11.2 Immediate suspension or termination
The 30-day notice period does not prevent immediate restriction, suspension or termination where reasonably necessary because of: fraud; illegal activity; material breach; serious security risk; abuse of the Mangaale platform; serious policy violations; non-payment after appropriate notice; activities that could materially harm customers, restaurants, riders or Mangaale; or a government, regulatory or legal requirement.
Where practical we will warn you first and give you a chance to fix the problem.
11.3 After termination
On termination your licence ends. Deletion of your data follows the retention approach set out in the Privacy Policy and on the account-deletion page; records we must keep for tax, accounting or fraud-prevention purposes are retained for the statutory period.
12. Disclaimers
The app is provided "as is". To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
The app is a tool for running your business. It does not give you legal, tax or food-safety advice, and it does not relieve you of your own regulatory obligations, including FSSAI compliance and correct GST treatment. Reports and totals in the app are provided to help you; you remain responsible for checking your own books.
13. Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Subject to that, and to the extent the law allows: we are not liable for lost profits, lost sales, lost or corrupted data, or indirect or consequential loss; and our total liability arising out of or in connection with these terms in any twelve-month period is limited to the fees you paid us for the app in that period.
14. Changes, governing law and contact
We may change these terms. If a change is material we will give reasonable notice in the app or by email. Continuing to use the app after a change takes effect means you accept it.
14.1 Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of India. Subject to applicable law, the courts of competent jurisdiction in Bijnor, Uttar Pradesh, India have exclusive jurisdiction over disputes arising out of or relating to these terms or the Mangaale platform.
